Returns (Right of Withdrawal)
Consumers and sole proprietors within the meaning of the Terms and Conditions (i.e., individuals entering into a contract with the Seller directly related to their business activity, where the content of the contract indicates that it is not of a professional nature for them) who have concluded a distance contract may withdraw from it within the time limit specified below without providing a reason and without incurring any costs (except for the costs indicated below). To comply with the time limit, it is sufficient to send a declaration of withdrawal before the expiry of this time limit. A declaration of withdrawal from the contract may be submitted, for example:
in writing to the following address: MMGMOTORSPORT.COM ul. Kępa 8, 97-200 Tomaszów Mazowiecki
in electronic form via email to: biuro@mmgmotorsport.com
The withdrawal period begins:
for a contract in which the Seller delivers goods and is obligated to transfer ownership thereof (e.g., a sales contract) – from the moment the Consumer or a sole proprietor or a third party designated by them, other than the carrier, takes possession of the goods; and in the case of a contract that:
covers multiple goods delivered separately, in batches, or in parts – from the moment the last goods, batch, or part are taken into possession, or
involves the regular delivery of goods over a specified period – from the moment the first goods are taken into possession;
for other contracts – from the date of conclusion of the contract.
In the event of withdrawal from a distance contract, the contract is deemed not to have been concluded.
The Seller is obligated to immediately, and no later than 14 calendar days from the date of receipt of the Consumer's or Individual Business Owner's declaration of withdrawal from the contract, refund all payments made by the Consumer or Individual Business Owner, including the costs of delivery (excluding additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery method available in the Store). The Seller will refund the payments using the same payment method used by the Consumer or Individual Business Owner, unless the Seller has expressly agreed to a different refund method that does not incur any costs for the Consumer or Individual Business Owner. If the Seller has not offered to collect the goods from the Consumer or Individual Business Owner itself, the Seller may withhold the refund of payments received from the Consumer or Individual Business Owner until the goods are returned or the Consumer or Individual Business Owner provides proof of return of the goods, whichever occurs first. The Consumer and the Single-User Business Owner are obligated to immediately, and no later than 14 calendar days from the date on which they withdrew from the contract, return the goods to the Seller or hand them over to a person authorized by the Seller to collect them, unless the Seller has offered to collect the goods themselves. To meet the deadline, it is sufficient to return the goods before their expiry. The goods should be returned to the following address: MMGMOTORSPORT.COM, ul. Kępa 8, 97-200 Tomaszów Mazowiecki.
The Consumer and the Single-User Business Owner are liable for any diminished value of the goods resulting from handling them in a manner that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Possible costs associated with the Consumer's and Single-User Business Owner's withdrawal from the contract, which they are obligated to incur:
If a delivery method other than the cheapest standard delivery method available in the Store was selected, the Seller is not obligated to refund the difference in price between the selected delivery method and the cheapest standard delivery method available in the Store.
The Consumer and the Individual Business Owner bear the direct cost of returning the goods.
The right of withdrawal does not apply to the Consumer or Individual Business Owner in the case of a contract:
where the subject of the contract is a non-prefabricated product, manufactured according to the Consumer's or Individual Business Owner's specifications, or intended to meet their individual needs;
where the subject of the contract is a perishable product.
